Child maintenance without divorce: court order or claim, and documents to prepare
Marriage does not prevent a child maintenance application in Ukraine. Choose between an agreement, a court order and a claim, document needs and avoid duplicating an existing award.
Must you divorce first?
Parents’ duty to support a child until adulthood does not depend on divorce. Where one parent fails to provide proper support, maintenance can be sought during marriage. Living together does not itself establish who actually pays for the child’s needs.
- This guide concerns maintenance for a minor child under Ukrainian law. Spousal maintenance and support for an adult child have different grounds.
- Check parentage documents, where the child lives, payments already received and any existing agreement, court order or judgment before choosing a procedure.
When an agreement is suitable
If parents can agree regular support, specify the amount, payment dates, method and clear payment references. Oral promises and unexplained transfers are harder to assess in a dispute.
- A child maintenance agreement under Article 189 of the Family Code must be written and notarised. Its terms must not infringe the child’s statutory rights.
- If the agreement is breached, the law permits recovery through a notary’s enforcement inscription. Check the documents and conditions for this route first; an agreement does not automatically deliver payment.
Which applications qualify for a court order?
Order proceedings have statutory limits. Article 161(1)(4)–(5) of the Civil Procedure Code permits the following applications where they do not involve establishing or disputing parentage or require other interested persons to be joined.
- An income share: one quarter for one child, one third for two, and one half for three or more; capped at ten age-appropriate subsistence minimums per child.
- A fixed amount: 50 per cent of the age-appropriate subsistence minimum. This is a specific order option, not any figure the applicant considers sufficient.
- The court considers the application without a hearing or notifying the applicant and debtor. An order is not guaranteed: documents and statutory grounds are checked. Applicants may also choose simplified claim proceedings for Article 161 demands.
When a claim is needed and how to support the amount
A different fixed amount, disputed parentage or the necessary participation of other interested persons falls outside the described order route. A claim allows an individual amount to be justified and disputed facts examined.
- Article 182 requires consideration of the child’s and payer’s health and finances, other dependants, property and other material circumstances. Irregular income does not itself remove the duty to support a child.
- Prepare a clear monthly budget for food, clothing, education, transport and medical needs. Support expenses with documents and distinguish one-off purchases from recurring costs. A social-media photograph of expensive belongings does not by itself establish income or ownership.
Documents to collect
Requirements depend on the procedure and facts. Check the application’s form, the competent court and attachments before filing.
- The applicant’s identity documents, the child’s birth and residence documents, and known identifying details and address of the other parent.
- Records of payments received, correspondence about support, existing agreements, previous decisions and enforcement documents, if any.
- A calculation of the child’s needs, receipts, education contracts, medical documents and lawfully obtained information about the payer’s income and property.
- The applicant’s account details and proof of the account; if none exists, that information and the preferred payment method. Article 163(6)–(7) specifically requires this for an order application.
The start date and an existing award
Under Article 191, maintenance is awarded from the date the claim is brought, or the date the court-order application is filed. The parents’ separation date does not automatically replace that date.
- An award for an earlier period requires evidence of efforts to obtain maintenance and the payer’s evasion, and cannot exceed ten years. It needs separate justification rather than automatically covering the entire separation.
- If a judgment or order already exists, first check its terms, enforcement and payment records. Non-payment under an existing award calls for enforcement work; changing the amount or recovery method requires assessment of the relevant grounds. An identical fresh demand does not replace those steps.
Frequently asked questions
- Is a court fee payable? Article 5(1)(3) of the Court Fee Law exempts claimants seeking maintenance and applicants for the corresponding court order. Fees for other demands combined with maintenance must be checked separately.
- Can a larger fixed amount be requested by court order? The described fixed-amount order option is limited to 50 per cent of the relevant subsistence minimum. A different amount should be justified in a claim.
- Is living separately enough? No. Documents must establish the child’s circumstances, entitlement and support arrangements; a disputed amount needs supporting evidence.
Preparing for legal help
- Explain where the child lives, current payments, any previous decisions and the outcome sought: regular support, an adjusted amount or enforcement. A consultation can identify the appropriate procedure and missing documents without requiring divorce first.
