Divorce documents: checklists and application structures
Document checklists and two illustrative structures for Ukrainian proceedings: one spouse’s claim and a joint application by spouses with children.
Illustrative structure of one spouse’s claim
- This is a preparation outline requiring verified facts and adaptation, not a filing-ready claim. Family Code Article 110 and CPC Articles 175 and 177 govern the relevant claim and attachments.
- 1. Identify the competent court and parties, addresses, known contacts and required electronic-cabinet information.
- 2. Set out marriage registration date, authority and record number, relevant child information, actual grounds and supporting evidence. Do not copy another person’s facts.
- 3. Example requested relief: “Dissolve the marriage between [names], registered on [date] by [authority], record No. [number].” Additional requests concerning names, costs, children or property need separate assessment and wording.
- 4. Include applicable pre-action steps and preservation measures, evidence and original holders, records that cannot be supplied, estimated litigation costs and confirmation that no identical claim has been filed.
- 5. List attachments, date and proper signature: evidence, fee or exemption records, representative authority and required copies or service evidence. The package depends on filing method. Court documents must be prepared in Ukrainian.
Illustrative joint application by spouses with children
- For both spouses’ genuine agreement, assess Family Code Article 109 and separate proceedings under CPC Articles 293–294. This differs from a claim brought by one spouse.
- 1. Identify the court, both applicants, addresses, contacts and procedural details, then the marriage, children and shared intention to divorce.
- 2. Describe arrangements for children’s residence, living conditions and upbringing by the parent living separately. Attach the written agreement required by Article 109(1).
- 3. The agreement on the amount of child maintenance must be notarised under Article 109(2). Its existence and consistency require specific review.
- 4. Example request: “Dissolve the marriage between [names], registered on [date] by [authority], record No. [number].” List attachments and provide the date and proper signatures. Prepare the final court document in Ukrainian.
- The court assesses genuine intention and parents’ and children’s rights. Where there is no joint decision or a dispute arises, identify the correct proceedings first.
Match the documents to the route
- One spouse’s claim and a joint application with children have different requirements. CPC Articles 175 and 177 govern claim content and attachments; Family Code Article 109 governs the relevant joint application.
Prepare available information
- Identify the marriage record or information needed to obtain a replacement, party identities and addresses, known contact details and required electronic-cabinet information.
- Include relevant child records, agreements, court orders and existing case documents. An exception to ordinary territorial jurisdiction may need supporting evidence.
- Check the court-fee payment document or evidence of a statutory exemption. Verify the current rate and court payment details before paying; this is separate from the lawyer’s fee.
Copies and originals
- Filing and service requirements depend on the submission method; the representative’s authority must also be documented.
- CPC Article 95 governs written evidence. Identify who holds the original; the court may require it. Do not send irreplaceable originals without agreement.
- Foreign documents may need translation and certification depending on the country, document and applicable treaties.
First contact is simpler
- Only a contact method and details are needed in the short form; name and description are optional.
- The lawyer then identifies the required materials and secure channel, explains the work and agrees fees. The first step does not require a passport or spouse’s personal data.
Official sources
This is a discussion checklist, not a universal filing package. Required attachments depend on the claim and circumstances.
