Marriage agreements in Ukraine: valid terms and common risks

What a couple may regulate, which terms create legal risk and what should be checked before notarisation.

Who may enter into the agreement

  • a couple who have filed to register their marriage or spouses
  • written form and notarisation are required
  • the parties must personally agree and understand the terms

What may be regulated

  • the property regime
  • family expenditure, liabilities and use of housing
  • financial maintenance of a spouse
  • a lawful approach to future division

Terms requiring particular care

  • personal relationships and child contact are outside its subject
  • a child’s statutory rights cannot be reduced
  • the agreement does not itself transfer registered real property
  • a party must not be placed in an extraordinarily disadvantageous financial position
  • assets, liabilities and third-party rights should be checked before notarisation
