Marriage agreements in Ukraine: valid terms and common risks
What a couple may regulate, which terms create legal risk and what should be checked before notarisation.
Who may enter into the agreement
- a couple who have filed to register their marriage or spouses
- written form and notarisation are required
- the parties must personally agree and understand the terms
What may be regulated
- the property regime
- family expenditure, liabilities and use of housing
- financial maintenance of a spouse
- a lawful approach to future division
Terms requiring particular care
- personal relationships and child contact are outside its subject
- a child’s statutory rights cannot be reduced
- the agreement does not itself transfer registered real property
- a party must not be placed in an extraordinarily disadvantageous financial position
- assets, liabilities and third-party rights should be checked before notarisation
