Inheriting a cooperative apartment: share payments and title
Documents and chronology needed to distinguish cooperative share rights from apartment ownership and identify the next notarial or court step.
Identify the deceased’s rights
- Membership or residence alone does not establish the estate’s contents. Check allocation, share payments, acquisition dates and title documents.
- Civil Code Articles 384 and 1218 require distinguishing occupation before acquisition, ownership and rights belonging to the deceased. Cooperative membership and apartment ownership are not interchangeable.
Dates and documents
- Obtain cooperative records of membership, payment amounts and dates, allocation documents, title and registry information.
- Check the law applicable when the right arose, marital circumstances and sources of payment. A missing modern registry entry is not by itself a conclusive answer.
- Prepare death and kinship documents, the will where applicable, inheritance-file information and proof of acceptance.
Choose the appropriate next step
- First assess whether documents can support notarial processing and obtain a reasoned refusal where there is an obstacle.
- A court claim must address the actual title or inheritance dispute; it is not an automatic replacement for notarial processing. Division of an accepted estate is a separate question.
Legal assistance
- An initial assessment identifies the chronology, missing documents and next steps. Document requests, representation and litigation are separately agreed.
- Share only a short outline initially; documents are exchanged through an agreed channel after a conflict check.
Official sources
The route depends on payment dates, title, inheritance acceptance and other participants’ documents.
