Practical guide
Divorce without the other spouse’s consent in Ukraine
One spouse’s right to file a divorce claim, notification of the other party and the matters the court must consider.
One spouse may bring a claim
- Family Code Article 110 allows one spouse to file. The other spouse’s consent is not a filing condition, but filing alone does not end the marriage.
- Under Article 112 the court assesses the relevant circumstances, including whether continuation would conflict with substantial interests of a spouse or children.
Notice and reconciliation
- Provide known addresses and information needed for proper service. Ignoring personal messages is not the same as proper court notification, and absence does not produce an automatic outcome.
- Reconciliation measures are subject to Article 111. They do not apply where one spouse has committed domestic violence under paragraph 2.
- Law No. 4073-IX removed Article 110 restrictions on filing during pregnancy and the first year after childbirth. Urgent protection from violence is a separate matter.
Discuss the scope
- Identify any child, maintenance or property disputes and existing proceedings. Divorce alone does not resolve those issues.
- Agree whether assistance includes claim preparation, filing and representation. Scope and fees are agreed in advance; court timing is not promised.
Official sources
Lack of consent does not justify promising an automatic decision or a fixed court timetable.
