Defined legal service

Challenging local-government decisions

Assessment of a council or executive-committee decision, refusal or inaction affecting your rights, including jurisdiction and an appropriate remedy.

The problem you need to resolve

  • a local authority adopted a decision affecting your rights
  • you received a refusal or no reply, or need a procedural legality assessment

What you receive

  • a legal position on the act or inaction
  • a document collection plan and agreed draft

What we do

  • review the questionnaire, deadlines and agreed document list
  • separate verified facts from assumptions and define the legal objective
  • Obtain the complete decision, annexes, application and service or publication details.
  • Review authority, procedure, reasons and the particular affected right.
  • Determine jurisdiction: a council’s involvement does not make every property or contract dispute administrative.
  • Identify remedies, evidence and deadlines; prepare the agreed request, application or claim.

What we need from you

  • complete decision or refusal
  • your application, filing reference and correspondence
  • evidence of the affected right or interest
  • receipt dates and existing proceedings
  • answer focused follow-up questions and verify the factual information
  • do not send a full set of sensitive documents before the conflict-of-interest check and agreement of a protected channel

Fees

  • Fees depend on the facts and scope of support. After a short discussion, we explain what the work includes and its cost. Fees are agreed before work begins.
  • A possible first stage is a written action plan: review of agreed documents, legal assessment, next steps, deadlines, risks and alternatives.
  • Additional objectives, extensive materials and foreign-language documents are discussed separately.
  • Court fees and other mandatory payments are separate from the lawyer's fee. Notarial, translation, valuation and expert costs are also agreed separately.

What may change the route

  • objections or new claims from another party
  • missing, inconsistent or newly received documents
  • the need for valuation, expert evidence, a notarial or registration step
  • existing court or enforcement proceedings, a missed or imminent deadline

When this service is not suitable

  • disagreement alone does not establish a sufficient claim without an affected right
  • filing does not automatically suspend the decision

How we report progress

  • we agree the communication channel before work begins
  • we report receipt of materials, completion of the assessment, document readiness and the next required action
  • where new facts or extra work arise, we first explain the effect on timing and fees and ask for your approval

Frequently asked questions

Which court has jurisdiction?

The relationship and requested remedy determine whether administrative, civil or commercial proceedings apply.

Can inaction be challenged?

The authority’s duty, application, filing evidence and response period must be checked.

Is there one appeal period?

No. The act, procedure and date when the infringement became known require individual assessment.
